By virtue of the power and authority contained in a Deed of Trust from James T. Smith and Georgia M. Smith, dated May 29, 2007, recorded as Instrument No. 07000433 in the Clerk’s Office of the Circuit Court for Pittsylvania County, Virginia with an original principal balance of $75,000.00, the holder of the indebtedness secured by said Deed of Trust having appointed as Substitute Trustee KYLE D. KORTE, by instrument duly executed, acknowledged and delivered, default having occurred under the terms thereof, and at the written request of the party secured thereby, the Substitute Trustee will offer for sale at public auction at the front steps of the Circuit Court for Pittsylvania County, 1 N. Main Street, Chatham, VA 24531, on

February 7, 2020 at 1:00 PM

Improved real property known as 312 Michaux Road, Cascade, VA 24069, and more fully described as:

BEGINNING at an iron in ditch set on the west side of Route 859, Cascade-North Carolina-Virginia line said beginning point is also being the southeast corner of Nellie Taylor; thence along the south line of said Nellie Taylor and Mrs. E.J. Taylor South 71 degrees 33’ West 424.80 feet to a stone in fence, a corner with Mrs. E.J. Taylor; thence along an existing fence South 20 degrees 17’ East 158.77 feet to an iron in the north line of Wilber Sims (formerly George Hairston); thence along the north line of said Wilber Sims South 86 degrees 56’ East 443.71 feet to an iron on the west side of Route 859; thence along the west side of Route 859 North 17 degrees 13’ West 321.50 feet to an iron, the point of beginning, containing 2.31 acres as per survey for Richard C. Minter and wife, Lucille G. Minter by Chris S. Koumparakis, R.L.S., dated January 3, 1974, recorded in the Clerk’s Office of the Circuit Court of Pittsylvania County, Virginia, in Map Book 15, at page 76.

IT BEING the same property conveyed to JAMES T. SMITH and GEORGIA M. SMITH, (as tenants by the entireties with right of survivorship), by General Warranty Deed of Sylvia Lee Gray, dated 8/29/1984, and recorded 9/6/1984, in the Clerk’s Office, Circuit Court, Pittsylvania County, Virginia, in Deed Book 747, at page 304. Said James T. Smith departed this life on 5/8/2015 and by operation of law the property passed to Georgia M. Smith.

TERMS OF SALE: Cash. A deposit of $30,000.00 or ten percent (10%) of the sale price, whichever is lower, in cash or certified check payable to the Substitute Trustee shall be required of the successful bidder at the time of sale before the bidding will be closed. The balance of the purchase price will be due within fifteen (15) days of the sale at the public auction.

As-is. The property will be sold in an “as-is” condition without warranties of any kind, and subject to conditions, senior liens, restrictions, easements and agreements of record affecting the same, if any.

Written notice of this Substitute Trustee’s sale, as required by Section 55.1-321 of the 1950 Code of Virginia, as amended, has been sent to the property owners as their addresses appear in the records of the noteholder, and to all parties prescribed therein.
