A federal trial for Paulette Genetha Toller previously set for Dec. 5 in Danville has been continued to Feb. 2020 according to court documents. 

Toller allegedly stole over 13,000 pills from SOVAH Health Danville between June 2017 and June 2019. 

A federal grand jury indicted Toller on July 24, 2019 on four counts of possession with the intent to distribute controlled substances. 

Counsel Randy Cargill, who is representing Toller, filed a motion for the continuance in order to have enough time to review documents from discovery. 

“Additional time is need {sic} for such preparation given the volume of discovery (thousands of pages of investigation materials and many hours of videotape) and given the press of other cases,” the motion states. “The undersigned cannot be ready for a trial on December 5, 2019 despite due diligence in light of these considerations.”

Toller was a licensed pharmacy technician according to the sworn statement of Drug Enforcement Administration Special Agent M. Patrick Long. 

On June 13, 2019, Toller was terminated by SOVAH Health, the document states, after contacting the DEA one day prior in regard to the theft of controlled substances. 

Toller allegedly found a ‘loophole’ in the system that allowed her to withdraw controlled substances from the hospital under different codes. 

All of Toller’s transactions were reviewed, and a total of 13,422 controlled substance pills were found to be missing. Two syringes of oxycodone were also missing.

The case will be heard in the federal courtroom in Danville, which is located above the Main Street post office. 

Toller is now expected to go to trial on Feb. 20, 2020 before Senior Judge Jackson Kiser.
