IN RE: REFERENDUM TO AUTHORIZE PITTSYLVANIA COUNTY TO LEVY A SALES TAX TO PROVIDE REVENUE SOLELY FOR CAPITAL PROJECTS FOR THE CONSTRUCTION OR RENOVATION OF PITTSYLVANIA COUNTY SCHOOLS.
ORDER OF REFERENDUM
COMES NOW, petitioner, the Pittsylvania County Board of Supervisors ("Board"), by counsel, pursuant to Virginia Code §§ 85.1-605.1 and 24.2-684, on its certified Resolution initiating a referendum and requesting this Court enter an Order calling a referendum to be held on the question of whether Pittsylvania County may levy a general retail sales tax at a rat not to exceed one percent (1%) as determined by the Board to provide revenue solely for capital projects for the construction and renovation of Pittsylvania County Schools.
After consideration of the attached Amended Petition, attached certified Amended Resolution, and the relevant provisions of Virginia Code, the Court finds that a referendum election on the question shell be order to be held during the general election scheduled for November 8, 2022.
Wherefore, it is ADJUDGED, ORDERED, and DECREED that there shall be referendum election, held in accordance with Virginia Code § 24.2-648, on the question of whether Pittsylvania County may levy a general retail tax at a rate not to exceed one percent (1%) as determined by the Board to provide solely for the construction or renovation of Pittsylvania county schools.
It is further ADJUDGED, ORDERED, and DECREED that the referendum election shall be held on the date of the general election currently scheduled for November 8, 2022, a Tuesday that is at least eight-one (81) days following the entry of the Order.
It is further ADJUDGED, ORDERED, and DECREED that the question shall appear and be printed on the ballot as follows:
"Should Pittsylvania County be Authorized to levy a general retail sales tax at a rate not exceed one percent (1%), provided the revenue from the sales tax shall be used solely for capital projects for the construction or renovation of schools in Pittsylvania County and that the sales tax shall expire by February 15, 2042?
[ ] Yes
[ ] No"
It is further ADJUDGED, ORDERED, and DECREED that the Clerk of this Court shall immediately forward an attested copy of this Order to the State Board of Elections and General Registrar for Pittsylvania County.
It is further ADJUDGED, ORDERED, and DECREED that the Clerk of the Court shall publish notice of the referendum in at least one (1) newspaper of general circulation in Pittsylvania County at least once a week for three (3) consecutive weeks prior to the election.
A copy of the Order shall be sent to counsel of record
